Using CallStone™

CallStone™ is a trade name of Heeley Enterprises LLC. These terms govern access to CallStone™. By creating, accepting, or using an account, you agree to these terms and any signed service agreement. You must be legally able to enter the agreement and may use the service only for lawful business purposes.

Accounts and workspaces

Workspace owners control invitations, roles, settings, integrations, and business records. You are responsible for authorized users, accurate account information, and protecting access to connected phone, email, calendar, and billing services. Access may be suspended to protect customers, the service, or third parties.

Messaging responsibilities

You must obtain and retain all consent required for calls and text messages before sending an automated message, clearly identify your business, honor STOP and every other reasonable opt-out method, follow quiet-hour and content rules, and comply with applicable law, carrier requirements, and provider policies. You may not use CallStone™ to send marketing messages unless you have the level of consent required for that message type. Subscriptions and billing

Paid plans are recurring subscriptions. Before you enter payment information, CallStone™ displays the plan price, billing interval, automatic-renewal terms, and cancellation method. By checking the recurring-billing authorization and completing Stripe Checkout, you expressly authorize Heeley Enterprises LLC to charge the payment method on file at the displayed monthly or annual price, plus applicable taxes, at the start of each billing period until you cancel.

You may cancel online through the Stripe customer billing portal available in your CallStone™ account. Cancellation stops future renewal charges and ordinarily takes effect at the end of the then-current paid period, so access continues through that date. You may also email callstonesupport@gmail.com if the portal is unavailable. Except where a signed agreement or mandatory law provides otherwise, charges are nonrefundable and we do not provide prorated refunds for a partially used period.

We may change prices prospectively after advance notice. We will provide renewal, trial-expiration, promotional-price, or material-change notices when applicable law requires them. Stripe displays and processes the final charge. You are responsible for accurate billing information, and failed payments may result in suspension or termination after any required notice or cure period.

Acceptable use

You may not use CallStone™ for unlawful, deceptive, abusive, discriminatory, infringing, or unsolicited communications; evade carrier safeguards; interfere with the service; probe another customer's workspace; resell access without permission; or submit information you are not authorized to process.

Truthful customer communications

You are responsible for the accuracy of your business name, services, availability, prices, offers, appointment information, and message content. You may not use CallStone™ to make misleading claims, impersonate another business, or promise outcomes that you cannot reasonably deliver.

Customer data

You retain your rights in customer data and grant CallStone™ permission to process it only to provide, secure, support, and improve the service and meet legal obligations. You are responsible for required notices, permissions, lawful bases, and responses to individuals whose data you submit. You must not upload customer information you are not authorized to process.

Service changes and availability

Features may depend on third-party communications, email, calendar, payment, hosting, and carrier services. CallStone™ may change or discontinue features and does not guarantee uninterrupted or error-free operation, message delivery, lead conversion, revenue, or legal compliance.

Disclaimers and liability

To the maximum extent permitted by law, the service is provided “as is” and “as available.” CallStone™ disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. CallStone™ is not responsible for lost leads, lost revenue, business interruption, or indirect, incidental, special, consequential, exemplary, or punitive damages arising from the service or a third-party provider.

Liability exclusions and limits in any signed service agreement apply. Where no signed agreement supplies a limit, CallStone™'s aggregate liability arising from the service will not exceed the greater of $100 or the amounts paid for the service during the three months before the event giving rise to the claim. These exclusions and limits do not apply to fraud, willful misconduct, gross negligence, personal injury caused by negligence, or other liability that cannot lawfully be excluded or limited. Some states do not allow certain warranty disclaimers or damage limitations, so parts of this section may not apply to you.

Indemnification

To the extent permitted by law, you will defend and indemnify Heeley Enterprises LLC and its personnel against third-party claims, penalties, and reasonable costs arising from your customer communications, content, unlawful or unauthorized data, violation of messaging or privacy law, or material breach of these terms. This obligation does not apply to the extent a claim results from CallStone™'s own negligence, willful misconduct, or violation of law.

State law and mandatory rights

Any governing-law or dispute provision in a signed service agreement controls. If none applies, these terms are governed by applicable United States law without overriding non-waivable rights you have under the law of your state. Automatic-renewal, cancellation, privacy, warranty, and consumer-protection rights that cannot legally be waived remain in effect.

Termination and contact

You may stop using the service and cancel through the billing portal. CallStone™ may terminate access for material breach, unlawful use, nonpayment, or security risk. Provisions concerning payment, ownership, disclaimers, liability, indemnification, disputes, and records that should reasonably survive termination will survive.
